1. Agreement to Terms

By accessing or using AI Apply ("the Service"), operated by Rocket Ship Dev ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AI Apply is an AI-powered job application assistant that helps users:

• Analyze and optimize resumes
• Generate cover letters
• Search job listings
• Track job applications

The Service uses artificial intelligence to generate content. AI-generated content is provided as suggestions only and may not be accurate, complete, or suitable for your specific situation.

3. AI-Generated Content Disclaimer

• AI-generated content may contain errors, inaccuracies, or omissions.
• You are solely responsible for reviewing, editing, and approving all AI-generated content before use.
• We make no representations about the accuracy or effectiveness of AI-generated content.
• We do not guarantee that using our Service will result in job interviews, offers, or employment.
• Career outcomes depend on many factors outside our control.

4. No Employment Guarantee

We provide tools to assist with job applications. We make absolutely no guarantee, express or implied, that:

• Your resume will be selected by employers
• You will receive job interviews or offers
• Our ATS scores reflect actual employer systems
• Our service will improve your employment prospects

Use of our Service does not create any employment relationship between you and us.

5. User Responsibilities

You agree to:

• Provide accurate information in your profile
• Ensure all resume content is truthful and accurate
• Not misrepresent your qualifications to employers
• Not use the Service for any unlawful purpose
• Not attempt to reverse engineer or copy our Service
• Maintain the confidentiality of your account credentials
• Be at least 18 years of age

You are solely responsible for:

• The accuracy of all content you submit
• Any misrepresentations in your applications
• Compliance with employer application requirements
• Any consequences arising from your job applications

6. Intellectual Property

Your Content

You retain ownership of your resume content, work history, and personal information. By using the Service, you grant us a limited license to process your content to provide the Service.

Our Content

The AI Apply platform, including its design, code, AI models, and features, is owned by us. You may not copy, reproduce, or create derivative works without our written permission.

AI-Generated Output

Content generated by our AI based on your inputs is provided to you for your personal use in job applications.

7. Payment Terms

Subscriptions

• Free plan: No payment required
• Pro plan: $19 USD/month
• Premium plan: $39 USD/month
• Prices subject to change with 30 days notice

Billing

• Subscriptions are billed monthly
• Payments processed by Stripe
• By subscribing, you authorize recurring charges to your payment method

Refund Policy

• No refunds for partial months
• Cancel anytime — access continues until end of billing period
• Contact contact@ai-apply.app for billing disputes within 30 days

Free Trial

The free plan is provided as-is with limited features. We reserve the right to modify or discontinue free plan features at any time.

8. Limitation of Liability

We specifically disclaim all warranties including but not limited to:

• Fitness for a particular purpose
• Merchantability
• Non-infringement
• Accuracy of AI-generated content
• Uninterrupted service availability

In no event shall Rocket Ship Dev, its developers, employees, or affiliates be liable for any:

• Indirect, incidental, or consequential damages
• Lost profits or employment opportunities
• Damages arising from reliance on AI-generated content
• Damages exceeding the amount you paid us in the past 12 months

This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Rocket Ship Dev, its developers, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Content you submit through the Service
• Misrepresentations in your job applications
• Your violation of any third-party rights

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-Party Services

Our Service integrates with:

• Anthropic (AI processing)
• Stripe (payment processing)
• Supabase (data storage)
• Adzuna and JSearch (job listings)

We are not responsible for the practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.

12. Service Availability

We do not guarantee uninterrupted access to the Service. We may:

• Modify or discontinue features at any time
• Perform maintenance that temporarily affects availability
• Suspend accounts that violate these Terms

13. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Provide false information
• Abuse the Service

You may cancel your account at any time via Settings.

14. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles.

For users in the United States, you consent to jurisdiction in Alberta, Canada for any disputes arising from these Terms.

15. Dispute Resolution

Before initiating legal proceedings, you agree to contact us at contact@ai-apply.app to resolve disputes informally. We will attempt to resolve disputes within 30 days.

16. Changes to Terms

We may update these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
